More than 10 years’ jail for security guard who forced daughter to perform oral sex on him

SINGAPORE — A 50-year-old security guard was on Wednesday (Jan 22) sentenced to a jail term of 10 years and another four months in lieu of caning for sexually assaulting his daughter when she was 15.

SINGAPORE — A 50-year-old security guard was on Wednesday (Jan 22) sentenced to a jail term of 10 years and another four months in lieu of caning for sexually assaulting his daughter when she was 15.

The man, who cannot be named due to a gag order protecting the victim’s identity, pleaded guilty to one count of penetrating his penis into his only child’s mouth in 2016.

The court heard that the girl, who is now 18, only spoke up in January 2018 after speaking to other victims of sexual assault at a welfare home she was relocated to.

She was placed in the welfare home in March 2017 after her father threatened her with a knife during a family dispute.

The victim kept quiet about the assault as she did not want to be the cause of a confrontation between her parents.

Their marriage was already marred by frequent disputes and she did not want to be the cause of their break-up.

She was also hesitant to speak up as her father had asked her in 2017 if she knew what would happen if she were to inform her Child Protective Officer about the sexual assault.

The girl finally informed her mother, who is 48, about the incident on Jan 21, 2018, leading to a police report being made two days later and his arrest on Jan 24 that year.

The father has been in remand since Jan 25, 2018.

FATHER AND DAUGHTER WENT DRINKING

Deputy Public Prosecutors (DPPs) Chew Xin Ying and Eugene Teh said the incident happened after the daughter accompanied her father to drink at a void deck near their one-room flat.

The victim drank a can of beer while her father had two to three cans and became intoxicated after consuming the beer.

When they returned home after drinking, the victim laid down on a sofa bed in the living room, where her father usually slept, to text her friends and did not enter their home’s only bedroom as she did not want to disturb her mother who was already sleeping.

The victim usually slept in the bedroom with her mother.

Shortly after, her father joined her on the sofa bed and she asked him to lull her to sleep as she had frequently got him to do by patting her thigh or arm in the presence of her mother.

But on this occasion, her father slipped his hand under her T-shirt and started rubbing her waist intimately.

She instinctively moved away from him but this did not stop her father, who pinned her down and tried to kiss her.

The victim protested and struggled but he repeatedly told her to keep quiet and eventually slipped his hand into her shorts and touched her private parts.

“At this juncture, the victim started to fear that the accused would rape her,” the DPPs said.

He then asked his daughter to perform fellatio on him and when she refused, he forced his penis into her mouth for about a minute.

ASKED VICTIM IF ‘IT WAS NICE’

The court heard that the next day, the father asked the victim whether “it was nice” and if she had “enjoyed” what they did the night before.

The victim replied that he should not have behaved in that manner given that she was his child.

The prosecution sought a jail sentence of at least 11 years for the father, pointing out that he “exhibited no qualms in abusing the trust reposed in him by sexually assaulting his own biological daughter”.

“By virtue of the victim’s relationship with the accused, she was also in an exceptionally vulnerable position,” they said.

While he had pleaded guilty, sparing the victim the trauma of having to relive her ordeal by having to testify against him, they said his offending was exacerbated by an “abject absence of remorse” in the immediate aftermath of the offence.

They further noted that the man’s charge would ordinarily attract eight strokes of the cane.

But since he is not liable to be caned as he is above 50 years old, which exceeds the statutory age limit set out under the Criminal Procedure Code, they asked the court to impose an additional four months’ jail to compensate for the deterrent effect of caning.
