16 ex-Umno members file appeal against court decision dismissing their leave to seek dissolution of party

KUALA LUMPUR — Sixteen former Umno members are appealing against the High Court's decision dismissing their leave application for a judicial review to declare the party illegal.

Counsel Irzan Iswat Mohd Nor, who represented the 16 applicants, said the appeal was filed at the Court of Appeal on April 27.

However, the hearing date for the appeal has yet to be fixed, he added.

Mr Irzan said he would seek further instructions from his clients on the committal order application against Umno secretary-general Tengku Adnan Tengku Mansor.

"The committal order application was over Tengku Adnan's press statement that the 16 applicants were sacked from Umno... because of the change of government after the 14th General Election, we will obtain further instructions from our clients whether to proceed with the committal application," he said.

The committal order application was filed on grounds that Datuk Seri Tengku Adnan had issued a press statement which was published in mStar news portal on April 21.

The applicants claimed that the statement was an attempt to foil their application to obtain leave to initiate a judicial review by saying that their membership had been terminated.

They alleged that the contents of the press statement was contempt as the court had not made a decision and the trial had not even started.

On April 27, the High Court dismissed the 16 former Umno members' application for leave to initiate a judicial review to seek the party's dissolution for not having its election within the prescribed time, thus violating its constitution.

Judge Kamaludin Md Said made the decision after finding that the decision of a political party relating to the affairs of the party shall be final and could not be questioned in any court on any ground as provided under Section 18C of the Societies Act 1996. THE NEW STRAITS TIMES
