Five months’ jail for man who flashed, poked woman with his private part on packed MRT train

SINGAPORE — A technical support officer was on a packed MRT train during the morning rush hour in May last year when his groin made contact with a fellow passenger. He then became sexually aroused and molested her.

Mohamad Rasid Mohamad Sani, 55, pleaded guilty to an outrage of modesty charge on Tuesday (Jan 21) and was sentenced to five months’ jail.

The court heard that Rasid, who is married and has an 18-year-old daughter, pulled down his underwear, exposed his erect penis through his pants’ zipper, and used it to poke the victim’s buttocks from behind.

The poke lasted for three to four seconds, Deputy Public Prosecutor Koh Mun Keong said. His act prompted the victim, 30, who cannot be named due to a court order, to turn around. 

She was then so aghast to see Rasid’s penis protruding out of his pants that she immediately shouted and snapped a photograph of him.

The incident took place when the train was travelling from Little India MRT Station to Dhoby Ghaut MRT Station on the North-East Line at about 8.10am on May 13 last year.

The matter was reported to the control station at Dhoby Ghaut once the train had stopped there, and Rasid was arrested that same day.

In arguing for a four-month jail sentence for her client, lawyer Harjeet Kaur of Edmond Pereira Law Corporation told the court that on the morning of the incident, Rasid was taking a detour while he was on his way to work so that he could see a doctor and take the day off.

“We are instructed that as the MRT train was moving, passengers were (swerving) back and forth… As a result, the victim’s buttock came into contact with our client’s groin,” she said. “Our client became aroused by the contact and realised that he had an erection.”

As for how Rasid came to expose his penis, the lawyer said that he was feeling uncomfortable due to the erection, which led him to adjust his pants and underwear.

“Our client’s exposed penis and the victim’s buttocks came into contact as the train moved. Immediately after, the victim turned around and shouted at our client. Our client quickly adjusted his pants and immediately apologised to the victim,” Ms Kaur said.

She added that Rasid is now “deeply embarrassed and angry” with himself for the act, which was carried out “in the spur of the moment, and against his better judgement”. 

Molesting or causing distress to the victim was not something that Rasid had set out to do that day, she said, pointing out that this was Rasid’s first brush with the law and he is unlikely to reoffend again as he has now learnt an “extremely bitter and painful lesson”.

Ms Kaur said that Rasid had been working at ITE College Central since 1990, and was terminated from his job on Dec 11 last year. 

His jail term started on Tuesday. He leaves his wife of 20 years, who recently suffered a stroke, and school-going daughter without their sole breadwinner.
