Man jailed 3 years for having sex at carpark with his 15-year-old stepdaughter

SINGAPORE — A 15-year-old girl had asked her stepfather to take her home from school so that she could rest before returning for a co-curricular activity later that day.

However, instead of taking her home, the 41-year-old man drove her to a multi-storey carpark where they had unprotected sex before they were eventually caught by a patrolling police officer on the afternoon of Jan 25 this year.

On Monday (Dec 23), the man was sentenced to three years’ jail. Last month, he pleaded guilty to having sex with a minor. He cannot be named as a gag order has been imposed to protect the Secondary 4 student’s identity.

A second charge over a similar incident was taken into consideration in sentencing.

Investigations found that this was the second time the man had sex with his stepdaughter in the same carpark. The first instance was sometime between Jan 14 and Jan 20 this year.

According to court documents, the relationship between the stepfather and his victim was initially a familial one. Over time, however, the pair gradually got closer and they would send each other frequent text messages.

This eventually led to the accused having sex with the victim. The court documents did not state if the girl objected to this, and previous media reports on the case suggested that these acts were consensual.

In mitigation, defence lawyer Dilip Kumar asked for the court to consider imposing a lighter sentence of one year's jail or less on his client.

Mr Kumar said that the entire incident had traumatised his client’s children, and his client had no wish to traumatise them further.

He said that his client did not “waste the court’s time” as he had pleaded guilty early and co-operated with the authorities.

A long jail term, he said, would impose unnecessary hardship on the family, as his client is the sole breadwinner.

Court documents showed that accused was supporting his current wife and 10 children — both adults had three and seven children respectively from their previous marriages — on a monthly salary of S$3,178.

Mr Kumar’s client had also asked for a one-month deferment in his sentencing date, so that he could “put things in order” both at home and his workplace, where he holds a managerial position as a technician.

In response, Deputy Public Prosecutor Yan Jia Kang argued against a lighter sentence and stated that the accused had abused the trust the victim had placed in him. “Hardship to the offender’s family is generally to be regarded as a normal consequence of imprisonment,” she added.

In passing his sentence, District Judge Teo Guan Kee agreed with Ms Yan. However, he allowed the accused to defer his imprisonment until Jan 3 so that he can settle his affairs.

The man’s bail has also been increased from S$15,000 to S$25,000.

For having sex with a minor, he could have been jailed for up to 10 years and fined.
