SINGAPORE — The Appeals Court has granted an application for a murder case to be re-sentenced after the defence filed the request in Singapore’s highest court today (Aug 13).

The case revolves around Bangladeshi construction worker Kamrul Hasan Abdul Quddus, who was found guilty of murdering Indonesian domestic helper Yulia Afriyanti.

Kamrul Hasan killed his 25-year-old lover in December 2007 at the construction site of Viz@Holland. He was convicted by the High Court in 2010 and handed the death penalty.

The Penal Code was amended last year, with an option under Section 300 (b), (c), or (d) for the accused to be given life imprisonment instead of the death penalty.

Defence counsel P Suppiah said in his application today that his client’s conviction was based on circumstantial evidence.

He also added that the case did not have direct evidence of his client’s intention to commit the offence, so it should fall under the amended sections.

The prosecution agreed.

In its response to the application, the prosecution added that there was no evidence as to what the accused’s motive was in strangling the deceased.

In light of other evidence that did not indicate that Kamrul Hasan had intended to kill his lover, the prosecution said it remains possible he committed the act in the heat of the moment.

As such, the prosecution said it does not object to the defence’s application.
