Teenager, 17, on probation for having sex with underage girls reoffends, this time with a 13-year-old

SINGAPORE — Despite already being placed on probation for having sex with two underage girls aged 14 and 15, a teenage boy reoffended by committing the same offence on a third teenage girl who was even younger at age 13.

SINGAPORE — Despite already being placed on probation for having sex with two underage girls aged 14 and 15, a teenage boy reoffended by committing the same offence on a third teenage girl who was even younger at age 13.  

On Monday (Jan 10), the 17-year–old boy pleaded guilty to three fresh charges of sexually penetrating a minor below the age of 16.

Two other charges for voluntarily causing hurt will be taken into consideration for sentencing, which will be heard on Jan 31. He cannot be named under the Children and Young Persons Act as he is under the age of 18.

District Judge May Mesenas has called for both a probation progress and a reformative training suitability report.

Reformative training is a regimented rehabilitation programme for offenders under 21 who commit relatively serious crimes, while probation is usually offered to first-time offenders between the ages of 16 and 21 and does not result in a criminal record.

THE CASE

Deputy Public Prosecutor (DPP) Jeremy Bin told the court that the latest case came to light on Sept 8 last year when the police were informed that the 13-year-old girl, who had been reported as lost, was found.

During the course of their investigation, the police found that the boy had been having sex with the girl after they entered into a relationship on Aug 5. 

Sometime that month, the boy told the girl that his family was not home and he invited her over. They had unprotected sex at his house.

And on the afternoon when the girl was found, she was also at the boy’s house where they again had sex, DPP Bin said.

In each instance, the girl consented to the acts. 

The boy was aware that the girl was underage.

DPP Bin, who called for a reformative training suitability report, highlighted that the boy reoffended immediately after a probation order was issued for his previous offences.

The youth was last sentenced to probation on Aug 20 last year for a total of four counts of sexual penetration of a minor, involving victims who were 14 and 15 years old.

“In short, the accused continued to reoffend while he was being assessed for probation or immediately after he was sentenced, or both,” DPP Bin said.

He added that earlier probation reports stated that the boy “self-reported distancing himself from young female acquaintances”, and his risk of reoffending is therefore low. 

“Given the facts of this matter, the accused would have been untruthful in reporting his circumstances to the probation officer.” 

Aside from having sex with the 13-year-old girl, DPP Bin said that the youth also physically abused the same girl twice. These two abuse charges will be taken into consideration for sentencing. 

“There is a pattern of increasingly serious criminal behaviour manifested in the accused’s offending history. By virtue of the above, the accused has demonstrated recalcitrance,” DPP Bin added.

For sexually penetrating a minor below 14 years of age, the boy could be jailed for up to 20 years and be fined or caned.
