Access to justice is a cornerstone of our legal system. Aspirationally, every accused facing a criminal charge should have access to legal advice or representation, if he wishes to.
The Law Society’s Criminal Legal Aid Scheme provides criminal legal assistance to the indigent, and plays an important role in access to justice.
The assertion that providing legal aid would encourage more crimes is neither logical nor credible.
It is far-fetched to suggest that the increased availability of criminal defence would become a carte blanche for the poor and needy to intentionally court the risk of punishment, including jail time.
